Terms of service

1. Agreement

By accessing or using Atom Apps at atom.apps.qwixl.com (“the Service”), you agree to these Terms of Service. If you use the Service for an organisation, you confirm you have authority to bind that organisation. “We”, “us”, and “Qwixl” mean Luke Chapman, sole trader trading as Qwixl. “You” means the person or organisation using the Service.

2. The Service

Atom Apps is a commercial catalog and distribution service for modules that run in Atom, Qwixl’s personal agent shell (atom.qwixl.com). The Service includes browsing listings, install hand-off, developer accounts, publish, and paid checkout facilitation.

3. Accounts

You are responsible for the accuracy of your account details and for keeping credentials secure. You are responsible for activity under your account. Developer accounts may publish listings and, where enabled, receive payment for paid modules.

4. Developers and listings

You retain ownership of modules and listing content you submit, and you grant us the licence needed to host, display, distribute, and promote them through the Service. You warrant that you have the rights to publish the bundle and listing materials, and that they do not infringe third-party rights or applicable law.

We may review, refuse, delist, or revoke modules for safety, legal, or operational reasons. Blocking a developer may stop new downloads or purchases; entitlements already issued to buyers remain valid and renewable under our buyer-protection policy.

5. Paid modules, fees, and Stripe

For paid modules, the developer is the merchant of record. Payment is processed by Stripe Connect on the developer’s connected account. Atom Apps charges an application fee of fifteen percent (15%) of the Checkout amount on each successful paid purchase. Stripe’s processing fees apply separately.

Prices shown are set by the developer. We do not hold card numbers. Refunds, where offered, are handled in line with Stripe tools and applicable law; when we implement refunds on the platform, our default is that the application fee is not returned.

6. Buyers and entitlements

After a successful paid purchase, we may issue an entitlement certificate for use in a compatible Atom shell. Installed paid modules are intended to work offline after install, subject to periodic renewal when online and to any grace period we publish. Free modules do not require purchase.

7. Acceptable use

You must use the Service only for lawful purposes. You must not:

• upload malware, phishing, or other harmful content;
• infringe intellectual property or privacy rights;
• attempt to circumvent security, entitlements, or access controls;
• abuse APIs, scrape aggressively, or interfere with the Service;
• misrepresent identity, pricing, or capabilities of a listing.

We may suspend access for serious or repeated breaches.

8. Intellectual property

Atom Apps branding, site design, and software we provide are owned by us or our licensors. Atom shell software and related open-source materials are governed by their own licences. You keep ownership of your modules and content as set out in section 4.

9. Privacy

We process personal data as described in our Privacy Policy.

10. Warranties and disclaimers

We provide the Service with reasonable skill and care. Except as expressly stated, the Service is provided “as is”, and we do not warrant that it will be uninterrupted or error-free. Modules are provided by developers; we do not warrant third-party module quality or fitness for purpose.

11. Limitation of liability

To the fullest extent permitted by law, our total liability to you in any twelve-month period is limited to the fees you paid us in that period (or £100 if none). We are not liable for indirect or consequential loss, or for loss of profit, revenue, or goodwill. Nothing excludes liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify us against claims, losses, and costs arising from your modules, listings, Content, or breach of these terms, except to the extent caused by our breach or negligence.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for breach, non-payment of amounts owed to us, or security or legal reasons. On termination your right to access developer features ends; we handle data in line with the Privacy Policy. Buyer entitlements already issued are handled under section 4 and 6.

14. Changes

We may update these terms and will update the “last updated” date above. For material changes we will notify you by email or a notice on the Service where appropriate. Continued use after changes take effect is acceptance of the updated terms.

15. Governing law

These terms are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of its courts. If you are a consumer, you keep the protections of the law of your country of residence.
